EU POP Regulations are Updated, with Limit for Pentachlorophenol Specified

Published on 2021-02-23 in the Official Journal of the European Union, the European Commission Delegated Regulation (EU) 2021/277 has amended Annex I to POP Regulation (EU) 2019/1021 (on “Persistent Organic Pollutants”) as regards pentachlorophenol and its salts and esters. 

 

This amendment fills the void of the limit for Pentachlorophenol (PCP) and its salt and esters. Those substances, though originally listed in Annex I to the POP Regulation, were initially not specified with any Unintentional Trace Contaminant (UTC) limit value.

 

Changes:

This new Delegated Regulation adds the limit to Part A of Annex I to Regulation (EU) 2019/1021 (POP Regulation), in the 4th column of the entry for pentachlorophenol and its salts and esters, as shown below:

 

For the purposes of this entry, point (b) of Article 4(1) shall apply to concentrations of pentachlorophenol and its salts and esters equal to or below 5 mg/kg (0.0005 % by weight) where they are present in substances, mixtures or articles.

 

Effective Date:

2021-03-15, which is the twentieth day following its publication in the Official Journal of the European Union, is the date for this new Delegated Regulation to enter into force.
