Argentina Postpones Enforcement of Its New Conformity Mark Requirements for Certain Toys

On 27 October 2025, Argentina's Ministry of Economy Secretariat of Industry and Commerce (Ministerio De Economía Secretaría De Industria Y Comercio) published Legislation and Official Notices Resolution 428/2025 to defer the implementation of Resolution 237/2024 dated 2024-08-29 regarding the new conformity Mark.

Scope:

This resolution for postponement covers toys, or parts of toys, that may contact food directly. This includes toys whose primary packaging or wrapping is in direct contact with food, or that are used in food-handling areas not intended for play.

New Conformity Mark:

This new marking (introduced in Resolution 237/2024) includes a QR code linking to the product's Declaration of Conformity (which must be in Spanish and signed by the local manufacturer or importer) and is part of a larger effort to update regulations, align with international standards, and streamline the certification process, which will now be conducted through a digital platform ("Plataforma de trámites a distancia" (TAD) or its future digital equivalent).

The marking must be placed before the marketing of the product, and it should be placed in a visible location on the product or on its primary packaging.

Effective Dates after the Postponement

Given the difficulty that some market operators may face in complying with the requirements established in the aforementioned regulations within the established timeframes, particularly with regard to the aforementioned toys that may come into contact with food, it is necessary to suspend the entry into force of the requirement for the "conformity mark" in relation to them, for a specified period.
